By creating an account, purchasing a plan, accepting an invitation, or using the service, you agree to these Terms. If you act for an organization, you represent that you can bind it. Manual agency work is governed separately by the Manual Services Terms.
1. Who may use the service
You must be at least 18 years old and able to form a binding contract. Accounts are intended for professional, organizational, and business use. You must provide accurate account information, protect credentials and API keys, and promptly tell us about suspected unauthorized access. You are responsible for activity by people you invite to your workspaces and cases.
2. The DocAccessible service
DocAccessible provides document checking, automated remediation assistance, hosted accessible HTML, rebuilt tagged PDF output, reviews and approvals, website PDF monitoring, accessibility feedback, program intake, API and webhook features, and secure vendor exchange. Features and allowances vary by plan and are described on the pricing page. We may improve, replace, or discontinue features, provided we do not retroactively change a paid order without the rights stated in that order.
3. Customer content and permissions
You retain ownership of documents, images, comments, metadata, and other material you submit (“Customer Content”). You grant DocAccessible a limited, worldwide license to host, copy, parse, transform, analyze, transmit, display, and delete Customer Content only as needed to provide, secure, support, and improve the service as described in the Privacy Policy and, where applicable, the Data Processing Addendum.
You represent that you have the rights and lawful basis needed to upload, modify, process, share, and publish Customer Content. You control whether a document is private, shared through a restricted link, unlisted, or public. Publishing can expose content to anyone with the resulting URL or, for a public page, to search engines.
4. Automated and AI-assisted output
Automated checks, scores, alternative-text suggestions, structure proposals, rebuilt PDFs, hosted HTML, comparisons, and routing recommendations are assistance, not a certification or legal opinion. They can miss reading-order issues, complex table relationships, charts, forms, language changes, contextual meaning, and assistive-technology behavior. Rebuilt PDFs may change layout, pagination, forms, or other visual behavior. You are responsible for reviewing important output and determining whether it is appropriate for your audience and legal obligations.
5. Acceptable use
You must comply with the Acceptable Use Policy. We may limit, suspend, or remove access when reasonably necessary to protect users, customer data, the service, or third parties; respond to a legal requirement; investigate abuse; or prevent material operational harm.
6. Subscriptions, renewals, and taxes
Paid software plans renew monthly until canceled. Prices, plan limits, and billing frequency are shown before checkout. Dodo Payments processes payment details; DocAccessible does not store full card data. You authorize the applicable recurring charge and are responsible for taxes, duties, and accurate billing details except taxes imposed on our income. 7. Free service, trials, and beta features
Free, evaluation, beta, or preview features may have additional limits and may be changed or withdrawn. They are provided without a service-level or continued-availability commitment. Do not rely on a preview feature for a production deadline unless a signed order says otherwise.
8. Confidentiality and support access
Each party will protect non-public information received from the other using reasonable care and use it only for the relationship, except where disclosure is authorized or legally required. Customer Content marked private is treated as confidential. When you request account-specific support, a restricted administrator may use a time-limited support session with a recorded reason and audit trail. Support access does not reveal passwords or payment-card data.
9. Our intellectual property
DocAccessible and its licensors retain all rights in the service, software, designs, documentation, trademarks, and technology, excluding Customer Content. We grant you a limited, non-exclusive, non-transferable right to use the service during your authorized term. Feedback may be used without restriction or compensation, but we will not identify you publicly without permission.
10. Third-party services
The service depends on providers for payments, email, infrastructure, storage, AI analysis, malware scanning, validation, analytics, and error monitoring. Their availability and separate terms may affect particular functions. Current provider roles are explained in our Subprocessor List. We are not responsible for third-party sites you independently choose to visit or integrate.
11. Suspension and termination
You may stop using the service or delete an eligible account at any time. Shared-workspace ownership must be transferred or resolved before deletion. We may suspend or terminate access for material breach, nonpayment, security risk, unlawful use, or harm to the service. Where practical, we will provide notice and an opportunity to cure. On termination, access ends and data is handled under the Privacy Policy and applicable order; provisions that by nature should survive, including payment, ownership, disclaimers, liability, and dispute terms, remain effective.
12. Disclaimers
To the maximum extent permitted by law, the service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. DocAccessible does not warrant that any output is legally compliant, certified, complete, or suitable without qualified human review. Nothing here limits a warranty that cannot lawfully be excluded.
13. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, or data. Each party's total liability arising from the service will not exceed the amount paid or payable for the service during the 12 months before the event giving rise to the claim. The cap does not apply where prohibited by law or to fraud, willful misconduct, breach of confidentiality, infringement or misappropriation of the other party's intellectual property, or payment obligations.
14. Indemnity
You will defend and indemnify DocAccessible from third-party claims arising from Customer Content, your publication or use of output, your violation of law, or your material breach of these Terms. We will promptly notify you and allow reasonable control of the defense, subject to our right to participate.
15. Governing terms and disputes
A signed order form may specify governing law and forum. If it does not, the laws and courts applicable to DocAccessible's principal place of business govern, without regard to conflict-of-law rules, except that mandatory local consumer or data-protection rights remain unaffected. Before filing a claim, each party will try in good faith for 30 days to resolve it through the contact route. Either party may seek urgent injunctive relief to protect data, security, or intellectual-property rights.
16. General terms
Neither party may assign these Terms without consent, except in connection with a merger, acquisition, reorganization, or sale of substantially all relevant assets. Neither party is liable for delay caused by events beyond reasonable control. Waivers must be explicit. If a provision is unenforceable, it will be narrowed only as needed and the remainder stays effective. These Terms, incorporated policies, and applicable orders are the entire agreement for the service and do not create a partnership, agency, or employment relationship.
17. Changes and contact
We may update these Terms to reflect service, legal, or operational changes. We will update the effective date and provide additional notice for material changes affecting active paid customers.
